UK Closes 2 Immigration Routes Used by Foreigners to Extend Their Stay, Reveals Alternatives

The UK Home Office issued a broad statement outlining changes to the country’s Immigration Rules, closing at least one pathway that migrants had previously used to extend their stay and highlighting the Skilled Worker route as one of the routes that remains operational.

The policy paper, known as HC 584, was presented to Parliament and includes amendments to dozens of appendices ranging from student and visitor visas to EU settlement and family routes.

The majority of the changes will go into effect on October 8, 2026, with additional updates scheduled for October 29, November 30, and December 9, 2026.

What the New Regulations Remove

One of the most significant procedural changes concerns how applications are counted.

According to the updated rules, anyone applying to vary a previous application must still submit their biometrics by the original application’s deadline, or the new application will be considered invalid.

This closes a loophole that some applicants were using to manage their immigration timelines.

The rules also tighten suitability criteria, including a new provision allowing the Home Office to refuse or cancel permission to stay for anyone found to have acted in a way that undermined immigration controls.

For those following legacy Tier 1 routes, the changes remove several investment and entrepreneurship tables from Appendix A, reducing the evidence required to qualify for indefinite leave to remain as a Tier 1 Entrepreneur.

Crucially, the removal of references to entry clearance and leave-to-remain in specific paragraphs indicates that those older extension options no longer exist in their original form.

While the changes close or restrict certain legacy pathways, the Skilled Worker route remains the primary permission-to-stay option under the updated rules.

Changes to the Skilled Worker appendix will go into effect on October 8, 2026, but the route itself will remain available as a means of extending or regularizing a stay in the United Kingdom.

The updated rules also clarify the procedure for fee waiver applicants.

According to the new wording, an applicant who requests a fee waiver and then submits an application via a different route will have their application dated from the day they submit it, not the day of the original waiver request.

This is a practical change that will impact how the Home Office calculates application timelines.

The full statement of changes includes changes to over 20 appendices, including those governing visitors, students, family members, domestic abuse victims, and long-term residency applicants.

Applications submitted prior to each respective implementation date will be decided in accordance with the rules in effect on the day before the changes were implemented.
