Aminu Babba Dan’Agundi, Senior Counsel to the 15th Emir of Kano, Aminu Ado Bayero, has announced plans to challenge the recent Court of Appeal ruling favoring the 16th Emir of Kano, Muhammadu Sanusi II.
Dan’Agundi, who also holds the esteemed traditional title of Sarkin Dawaki Babba of the Kano Emirate, disclosed his intentions during a press briefing held at the Nassarawa Mini Palace in Kano.
The Court of Appeal had earlier ruled that the Federal High Court did not have the jurisdiction to hear Dan’Agundi’s case, which sought to address alleged violations of his fundamental human rights during the contentious emirship crisis.
The lead judgment proposed that the case be transferred to the Chief Judge of Kano State for reassignment. However, this decision was not unanimous, as two other judges on the panel dissented, ultimately resulting in the appeal being struck out.
In his response to the ruling, Dan’Agundi criticized the judgment, describing it as incomplete and insufficient to resolve the emirship dispute.
“The emirship crisis has just begun; nobody can claim victory yet because we are challenging this ruling at the highest court,” he asserted.
Dan’Agundi confirmed that his legal team has been instructed to secure a certified true copy of the Court of Appeal’s judgment to initiate proceedings at the Supreme Court. He emphasized that filing an appeal at the apex court would automatically place a stay on the lower court’s decision until the matter is fully resolved.
“Once an appeal is lodged at the Supreme Court, the decision of a lower court is stayed until the case is fully resolved,” he explained.
Dan’Agundi also called on Kano residents to remain calm and uphold the principles of peace and the rule of law as the legal process continues.
“Whatever the Supreme Court decides will be final, and we submit to the will of Allah. Until then, no one should celebrate a victory,” he stated firmly.
The Kano emirship crisis remains a highly sensitive and symbolic issue, given the historical and cultural significance of the emirate. The legal battle has drawn widespread attention, with the outcome likely to have a lasting impact on traditional leadership structures in the region.
Dan’Agundi’s appeal signals that the dispute is far from over, and all eyes are now on the Supreme Court to provide a definitive resolution to the matter.
