5 US Work Visa Categories That Can Lead to Permanent Residency

The United States offers approximately 140,000 employment-based immigrant visas annually, providing foreign nationals with several pathways to permanent residency based on their professional qualifications, skills, work experience or investment capacity.

According to MSN, the visas are distributed across five employment-based preference categories during each US fiscal year.

Successful applicants may also be eligible to bring their spouses and unmarried children to the United States, subject to applicable immigration requirements.

The five visa categories cover a wide range of applicants, including highly accomplished professionals, skilled workers, researchers, religious workers and investors.

EB-1: Priority Workers and Individuals of Extraordinary Ability

The EB-1 category is designed for individuals who have demonstrated extraordinary ability in fields such as science, education, business, the arts and sports.

It also covers outstanding professors and researchers, as well as certain multinational executives and managers.

Applicants with extraordinary ability may be able to file their petitions without a job offer from a US employer, provided they intend to continue working in their area of expertise.

Outstanding professors and researchers, however, are generally required to meet specific experience requirements and secure employment with an eligible US institution.

EB-2: Professionals With Advanced Degrees and Exceptional Ability

The EB-2 category is open to professionals with advanced degrees and individuals with exceptional ability in the sciences, arts or business.

Applicants generally need a job offer from a US employer and an approved labour certification before proceeding with their immigration petition.

However, those who qualify for a National Interest Waiver may be exempt from these requirements. The waiver allows eligible individuals to file a petition without employer sponsorship if their proposed work is considered to be in the national interest of the United States.

EB-3: Skilled Workers, Professionals and Other Workers

The EB-3 category provides an immigration pathway for foreign nationals whose qualifications meet the requirements of specific jobs.

It is divided into three groups: skilled workers, professionals and other workers.

Skilled workers are generally required to have at least two years of relevant training or work experience. Professionals are typically expected to possess a bachelor’s degree or an equivalent foreign qualification.

Meanwhile, individuals seeking jobs that require less than two years of training or experience may qualify under the other workers category.

EB-4: Special Immigrant Workers

The EB-4 preference category is reserved for foreign nationals who meet specific special immigrant requirements.

Eligible applicants may include religious ministers and certain religious workers, international broadcasters, Iraqi and Afghan interpreters, special immigrant juveniles and some former US government employees who served abroad.

Certain foreign medical graduates and individuals who have served or enlisted in the United States Armed Forces may also qualify under applicable provisions.

Unlike many EB-2 and EB-3 applications, the EB-4 process generally does not require labour certification.

EB-5: Immigrant Investors

The EB-5 programme allows eligible foreign investors to seek permanent residency by making qualifying investments in businesses in the United States.

Applicants must invest the required capital in a new commercial enterprise and meet the programme’s job-creation requirements.

The programme is designed to attract foreign investment, support business growth and create jobs for American workers.

Overall, the five employment-based visa categories provide different pathways to permanent residency in the United States. The most suitable option depends on an applicant’s professional achievements, educational qualifications, work experience, special immigrant status or ability to make a qualifying investment.
